The Fairfax County Planning Commission held a public hearing in July, to change the zoning of the 4.38 acres, site of the proposed development, from PDH 5, to R-8. This would bring the zoning in compliance with the development; In addition the Commission also approved a request from the developer for a waiver of the age limitation allowing persons 55 and older to reside in the development. The Commission approved the requests.
The Commission’s approval does not have any impact on the Association’s vote not release the covenant on the 4.38 acres.

On September 20th, the Fairfax County Board of Supervisors will hold a public hearing on the Planning Commission’s recommendation to grant the changes requested by the developer. This is a public hearing and anyone may sign up to speak about the Commission’s report. The hearing is on Tuesday, Sept 20th, at the Government Center in Fairfax. (we do not have a time yet)
You can also provide testimony via email to Mt Vernon Supervisor Daniel Storck. You can express your comments and concerns, pro and con about the development to Supervisor Storck.

The Supervisors can vote to approve development as presented, vote to not approve or vote to make changes in the development.
The Supervisors vote, either way, does not have any effect on the Association’s vote on the covenant.
